Are lunch breaks required by law?

I don't always get a lunch break.

No, not according to the Fair Labor Standards Act. There is no provision for meals/lunch breaks. There may be laws in your state requiring breaks, but the question does not indicate a specific state. Generally, when it comes to labor law, the more beneficial law between federal and state will be the one that applies to the works.

Federal laws do not require employers/companies to provide or pay for lunch breaks. However, in several states/jurisdictions lunch breaks are mandatory. The following are states that have laws in place which mandate employers to pay: California, Colorado, Connecticut, Delaware, Illinois, Kentucky, Maine, New York, Nebraska, New Hampshire, Nevada, North Dakota, Oregon, Rhode Island, Tennessee, Washington and West Virginia.

Depending on how long your shift is your are required by law to receive a break. Check with your states labor laws online. In Ohio if you work for more then 5 hours you are required to get a 15 min break. However your state may be different then mine.

A break is required if an employee works more than three and a half hours of work. In this case, the break is 15 minutes. A six hour or longer shift requires a 30 minute meal break, though employees do not have to be paid for the lunch break time.
