Can a landlord sue for non-payment of rent when there is no lease in New Jersey?

Even without a lease, there is an understanding that rent will be paid. No one lets their property for free. A lease specifies far more than monthly rent. Even in the absence of a lease, the landlord is entitled to rent and can evict and sue for non-payment.

In New Jersey, if there is no written lease, the rental is considered month-to-month. As long as the landlord provides written intent to claim unpaid rents, the landlord may sue. The procedures are the same as if there was a written lease.

Yes. No one gets to live anywhere for free unless a agreement is in place beforehand. If there is no paperwork, a judge will determine, based on facts, the amount owed, after hearing from the involved parties. It is reasonable to assume that a landlord takes on a tenant with the expectation of payment of rent, regardless of a lease.
