A refugee is a person who legitimately believes that for one reason or another his/her life is in danger should s/he be returned to his/her country. The individual would have to petition the US for status as a refugee and present specific reasons/evidence of the threat.

Different countries have different rules for allowing immigrants to attain refugee status. In general, though, an illegal immigrant has to be able to prove that if returned to his home country he will face ill treatment due to his religious or political beliefs. In the U. S. , these hearings can be quite complicated and really do require a lawyers' services.

He or she can't. Well if there are some substantial grounds for requesting immigration then they need to be proved. Otherwise being an illegal immigrant can get you deported back.
