The answer depends on where your Mother lived. You can contact the County Clerk's Office and ask. They have packets to assist you with the correct filings, if necessary. One thing to consider, the State may try to collect for care she may have received. A letter explaining the circumstances should suffice. You'll need multiple copies of the Death Certificate.

Normally if there are no assets, no probate needs to be filed. An estate always needs probating if there is real estate involved. All states are different so you need to check what the laws are in the state your mother lived in.

Call the courthouse with this question. Different states have different laws concerning these matters. The undertaker may know the answer to this question some states if there is no properties you don't have to file. A lot of people put like an ad in the paper for people who have any claims to come forth.

If your mother died without any assets then you do not need file probate. However you will need to notify companies where she owed money and provide them with a copy of her death certificate. Also file a copy of the death certificate with the county court house. Sorry for your loss!

well it varys from state to state. i'am not sure what state your from. But if she had no assets then more then likely you don't have to file probate. without knowing what state your from it's hard to say but most likely no.
