Should I buy a house that is going through probate?

It is probably not wise, you may not know what creditors might have claims to the house until the probate process is complete. You don't want to buy it, only to find out someone else owns it.

Property cannot be transferred until after probate. Have a Purchase & Sale agreement that returns your deposit if there are title issues that prevents the property from being sold.

If the house is being sold so that the proceeds can be split among heirs and is listed as "sale by estate of individual", you can buy it. Otherwise, do not buy a house until after probate is complete because the selling parties may not have clear title.

Do not bid until the process has been completed thoroughly. There is a chance you will bid and at the end find out there are unknown liens.
