What are the laws in Texas concerning divorce?

All property acquired during the marriage belongs equally to each spouse. For example, if he buys a car in his name while married, she still owns half of it. However, the same is true for debt. It doesn't matter if the house is in her name, they will both be equally liable for the mortgage.

Texas is like most states when it comes to divorce where the judge will take into consideration length of marraige and kids to distribute property. However it is one of only two states that recognize common law marraige. That is when two people have lived together for a certain time and will be treated as married regardless if they did.

A person must be a Texas resident for the prior six months. A person can file for divorce on the grounds of cruelty, adultry, no fault, or abandonment. If the spouse is in jail for a year on a felony conviction or in a mental hospital for three years, those are also grounds for divorce.

You must be a legal resident of the state with at least six months residency and 90 days in the county where it is filed. There are "no fault" divorces as well as grounds: adultery, cruelty, felony conviction, incarceration, confinement in a mental health facility, abandonment and/or living apart for more than three years.
