What constitutes second degree murder?

Murder of the second degree is not an intentonal killing. It is not planned. Third degree is if you intend to kill someone but you kill another person instead.

in legalities second degree is almost identical to first degree murder, the only diference is how your lawyer defends you. third degree murder is murder without malicious intent. IE: Accidental (vehicular homicide is technically 3rd degree murder)
