What if a roommate breaks a lease?

If the roommate breaks a lease with another roommate, that leaves the remaining tenant now responsible for the lease. The remaining tenant can sue the roommate to recover. If the roommate is party to the lease with the landlord, the remaining roommate is responsible but the landlord may take pity. The landlord can sue the defaulting roommate.

Whose name is on the lease: both names, or only yours, or only the room mates? You should talk to the landlord immediately to find out what can be re-negotated if you want to stay and what financial obligations there are if you want to leave, as per the lease.

You will need to contact your landlord as soon as your roommate moves out. Unfortunatly if you are both on the lease you are still responsible for the property. Which means if you decide to stay then you are responsible for the full rent and upkeep. However, if you break the lease the landlord can go after both of you.

You would need to ask a lawyer about it to see what would happen if it does. If the person was on the lease before that you should talk to a lawyer first.
