An affidavit is a voluntary legal statement in writing, made under oath. It differs from a deposition in that the person (affiant) is not being examined. There is no age limit, as long as the affiant has the mental capacity to take an oath as well as make an affirmation.

An affidavit is a written statement that is given by a person ("the "affiant") who swears, under penalty of perjury, that what is contained in the affidavit is true to the extent of the affiant's knowledge; affidavits can serve as evidence in certain land disputes and are frequently prepared in connection with preliminary proceedings concerning whether to hold a trial.
