Question by  TiffanyNoelle (19)

What is the next step to take after sending a cease and desist letter to a third party collection agency that sued me as well as had papers served in court?

I have a collection agency that is harassing me for something that I have paid for.

"Cease and desist" means that they must stop calling and sending letters. It does not prevent them from suing, which is a lawsuit, which is filed in court. Go to court, take proof of payment and all evidence that you tried to resolve the matter.

Anything that you send to them you need to file in the court as well and you should be sent a court date unless they settle.

If you have proof of debt paid in full, then send proof (but not the originals) along with the cease and desist letter. If this doesn't work, get a lawyer.

Who is in "contempt" of the court's "final" judgement? If you: Then file your appeal with the next-higher-up court. If them: File your motion/restraining-order alleging contempt-of-court with the court's/judge's clerk.

You can either change your phone number, or just not pick up your phone. Or add their number to your phone so you know who the call is coming from and avoid picking it up
