What kind of attorney do you need to declare someone is deceased in Alabama?

You may be able to save your money by going to your clerk of court and asking the for the proper records. If the person is missing and hasn't been found actually dead, consult the clerk- rule of thumb is 7 yrs, but there are procedures to go through.

An attempt to legally declare an individual dead in the state of Alabama must be done through the probate court where that person lived. Unless the matter is taken to court, no attorney is necessary. If it does go to court one should hire a family law attorney to handle the case.
