The British were still the legal authority even though the Colonials had already declared independence. The Revolution had not yet reached a decisive victory for either side.

Each individual territory which became states later began to join the organized group that was called the continental congress. Each state sent representatives to the meetings of the continental congress and they made the decisions that lead to the writing of the declaration of independence and later the US Constitution.
